The mother of a man fatally shot outside a Chick-fil-A in San Antonio, Texas in 2017, filed a wrongful death lawsuit on Thursday (June 21) against Tay-K for his alleged role in the shooting.

KSAT reports the rapper, born Taymor McIntyre, is accused of pulling the trigger—he was 16 at the time of the shooting. According to the suit, Tay-K and two accomplices were in a vehicle with 23-year-old Mark Saldivar when they robbed him of his camera equipment. The car was parked inside of the San Antonio Chick-fil-A parking lot. After stealing the camera, Tay-K and his crew ordered Saldivar out of the car. The man allegedly jumped on the hood in an attempt to stop the trio's escape. The suit claims that at that point, Tay-K exited the vehicle, shot Saldivar, got back in the car and fled. Saldivar died in the parking lot.

The shooting took place roughly one month after Tay-K took off his court-ordered ankle monitor and fled house arrest in the Dallas area, where he was awaiting a capital murder trial for his alleged role in the 2016 killing of a 21-year-old man in Mansfield, Texas. The rapper remained a fugitive for several months—during which he released his hit song, "The Race," about fleeing authorities—but was ultimately arrested in New Jersey.

The attorney representing Saldivar's mother told KSAT that she is seeking more than $1 million in damages from Tay-K.

Tay-K is currently being held at Tarrant County Jail in Fort Worth, Texas on a capital murder charge for his role in the Mansfield case, as well as an aggravated robbery charge in Arlington, Texas. He was denied bail in March. Last year, a judge ruled that the rapper, who turned 18 this month, will be tried as an adult, although Tay-K is not, as rumored, facing the death penalty. An accomplice in the 2016 shooting was recently sentenced to 20 years in prison.

In December 2017, the rapper signed a record deal with 88 Classic reportedly worth upwards of $600,000. "The Race" was certified platinum in January.
