A mom in Acworth Georgia is in trouble for allowing her 10 year old son to get a tattoo in memore of his deceased older brother. Chuntera Napier said her 12 year old son, Malik, was struck by a motorist and killed in Macon almost two years ago and her other son, Gaquan wanted a tattoo like hers to remember his older brother.

Georgia rules it is illegal for a child under the age of 18 to receive a tattoo. Mrs. Napier says she was unaware of the law and charged with misdemeanor child cruelty after someone at school noticed the tattoo on her son and contacted authorities. Chuntera was arrested on Tuesday and wasn't released until Wednesday morning. She says, " I always thought if a parent gives consent, then it's fine." " How can somebody else say it's not OK? He's my child, and i have a right to say what I want for my child." When Gaquan was asked why he wanted the tattoo, he replied "Because it represents my brother."
