Store Being Sued by Buc-ee’s for Punk Rock Remake of Beaver Logo

(KPEL) - Prometheus Esoterica Inc., a store that is self described as a "Goth Boutique", has been slapped with a lawsuit from Buc-ee's over the store's punk rock and Krampus t-shirts and stickers re-imagining the iconic Buc-ee's Beaver logo.

Buc-ee's Sues Florida Store Over Trademark Infringement

Winter Park, Florida store Prometheus Esoterica Inc. has been hit with a lawsuit over what Buc-ee's claims is trademark infringement concerning the Buc-ee's beaver logo.

Prometheus Esoterica Inc. has been selling t-shirts and stickers that have the Buc-ee's beaver logo altered into a gritty, punk rock version of the beaver logo as well as Krampus version of the beaver logo.

The punk rock Buc-ee's t-shirts show the beaver logo modified with tattoos, piercings, spikes, and a Dead Kennedys hat.

The other version is the Buc-ee's beaver logo modified into Krampus, the European horned beast who punishes bad children at Christmas time.

According to court documents obtained by WESH.com, Prometheus Esoterica Inc. is being sued by Buc-ee's for the following -

1. Federal trademark infringement

2. Federal unfair competition

3. Federal trademark counterfeiting

4. Common law trademark infringement and counterfeiting

5. Common law unjust enrichment

6. Violation of the Florida deceptive and unfair trade practices act.

Also in the lawsuit, Buc-ee's demands that Prometheus Esoterica Inc. be banned from further selling the t-shirts and stickers, return and/or destroy all products featuring the Buc-ee's beaver logo, pay damages as a result of the trademark infringement, and return all profits made by selling the t-shirts and stickers at an increased rate, possibly tripled.

Buc-ee's is also demanding a jury trial.

Documented were subitted May 29, and within 21 days, Prometheus Esoterica Inc. must reply to the complaint. If they fail to respond, 'judgment by default will be entered against you for the relief demanded in the complaint,' documents say.
