Local Churros Shop Speaks Out After Cease And Desist Dispute
A well-known Lafayette small business is speaking out after receiving a cease-and-desist letter from another tenant at Acadiana Mall.
On May 5, The Churros Boutique posted a message to social media explaining that they had been accused of copying another business and engaging in unlawful marketing. The post included a video showing one of the owners visibly emotional and uncertain about the future.
“We respectfully disagree,” the business wrote, emphasizing that their brand, menu, and vision were built independently with “authenticity, creativity, and love.”
Details Of The Legal Dispute
According to owner Melisa, the cease and desist claims The Churros Boutique is selling the same products, stealing customers, and must stop operations or face legal action.
The letter reportedly demands they halt business, destroy products, and potentially pay damages and attorney fees.
The owners argue the claims are unfair, noting they have operated in the mall since 2018. The other business, identified as Kay’s Cookiez, opened its Acadiana Mall location in November 2025.
“They showed up years after we were already established,” Melisa explained, adding that while menus may be similar, the timing raises concerns.
Attempts to contact Kay’s Cookiez for comment have not yet received a response.

Community Rallies Around Local Business
What followed the viral post was an immediate and overwhelming wave of support.
Customers flooded social media with messages defending the local shop. Many questioned how a business that has served the community for nearly eight years could be accused of copying a newer tenant.
Others shared personal stories and encouraged residents to stop by and support the family-run operation.
Owner Daniel summed up their approach simply, saying, “There is space for everyone.”
Acadiana Mall Responds To Situation
Acadiana Mall acknowledged the situation in a public statement on May 6, confirming they are aware of the dispute between tenants.
Mall management stated that all businesses operate under individual agreements and that they are working directly with those involved to ensure fairness.
They also emphasized their commitment to maintaining a positive environment for both tenants and customers.
What Happens Next
The Churros Boutique says it was blindsided by the legal threat and is currently evaluating its next steps.
Despite the uncertainty, they say the support from the community has been “mind blowing,” with increased foot traffic and encouragement pouring in.
The business, which expanded to Youngsville in 2025 and continues to host pop-ups across Acadiana, says it will remain focused on serving customers while navigating the legal process.
This story is still developing and will be updated as more information becomes available.
