Rappers David Banner and Ludacris along with R&B songbird Marsha Ambrosius have been slapped with a copyright-infringement lawsuit over allegedly using a soul sample without permission.

According to TMZ, Banner is being sued by soul singer Tyrone Davis, who recorded the 1979 ballad, ‘Be With Me.’ He and his publisher claim that the rapper-producer sampled his tune for his 2010 track, ‘Be With Me’ for his album, ‘Death of a Pop Star.’ Luda and Marsha are mentioned in the lawsuit because they appear on the song.

The gossip website didn’t list the other people named in the suit, but most likely studio mavericks 9th Wonder and Warryn Campbell, who produced the song, are wrapped up in this case as well.

No word on what monetary damages Davis and his publisher are seeking but they are probably looking for back royalties.

This lawsuit comes as Ludacris finds himself in paternity court trying to establish child support for a new baby.

The Atlanta rhymer wants a DNA test done on his new child, Cai Bella Bridges, who was born on Dec. 9. He also wants to set a limit on child support he’ll have to pay.

Luda claims that he earns $25,842.41 a month. Under Georgia law — the state in which Ludacris lives — his monthly child support payment would be set at $1,754.66 as a result of his income.

Those are some interesting numbers considering that Forbes magazine lists his net worth in 2013 at $12 million, but we digress.

As for the copyright-infringement lawsuit, attorneys for all parties involved had no comment on the matter.
